Who are affected by the 'Lov om beskyttelse af whistleblowere'?

The new whistleblowing law in Denmark is done in accordance with the requirements set out in the EU Whistleblowing Directive 2019.

On 17 December 2021, it became a legal requirement to establish an internal whistleblower scheme for all employers in the public sector with 50 or more employees, as well as for employers in the private sector with 250 or more employees. 

From 17 December 2023, the legal requirement will also apply to private companies with 50 to 249 employees. As a general rule, smaller companies with less than 50 employees are not required to establish an internal whistleblower scheme However, the company may be covered by other legislation that imposes requirements on this – e.g. if the company is covered by the Financial Business Act.

What is an Internal Whistleblower Scheme?

An internal whistleblower scheme is a system, where the employees, and if selected other stakeholders, anonymously or confidentially can report violations or problematic conditions in the workplace. This could be suspicion or knowledge of any illegal, unethical or irregular conduct.

Examples include matters regarding: 

  • Bribery and corruption
  • Fraud
  • White-collar crime
  • Personal data security violation
  • Serious environmental damage
  • Conflicts of interest
  • Sexual harassment or other gross harassment
  • Gross or repeated breaches of law
